Government Proposes Stronger Anti Paper Leak Law Through Amendment

Why in the News ?

The Government of India is introducing the Public Examinations (Prevention of Unfair Means) Amendment Bill, 2026 in the Lok Sabha. The Bill seeks to strengthen the 2024 Act by establishing fast-track courts and imposing stricter penalties to curb paper leaks and examination malpractices.

Key Features of the Amendment Bill, 2026

●  The Public Examinations (Prevention of Unfair Means) Amendment Bill, 2026 seeks to amend the Public Examinations (Prevention of Unfair Means) Act, 2024 to further strengthen the integrity of public examinations.

●  The Bill will be introduced in the Lok Sabha by Union Minister Dr. Jitendra Singh following approval by the Union Cabinet.

●  A major objective of the amendment is the establishment of Fast-Track Courts for the speedy investigation and trial of cases involving paper leaks, question paper theft, and organised examination fraud.

●  The amendment also proposes stricter punishments for individuals and organised groups involved in examination malpractices, thereby enhancing deterrence against such offences.

●  The legislation aims to ensure transparent, credible, and merit-based recruitment and admission processes, restoring public confidence in competitive examinations.

●  The move follows repeated incidents of examination irregularities that have affected recruitment examinations and admission tests across the country.

●  Strengthening the legal framework is expected to improve accountability, reduce organised cheating networks, and safeguard the interests of genuine candidates.

●  Paper leaks undermine the principles of fair competition, equal opportunity, and meritocracy, affecting lakhs of aspirants and delaying recruitment processes.

●  Fast disposal of cases through specialised courts will reduce prolonged litigation and improve the efficiency of the criminal justice system.

About Public Examinations (Prevention of Unfair Means) Act, 2024 :

●  The Public Examinations (Prevention of Unfair Means) Act, 2024 was enacted to prevent paper leaks, cheating, and other unfair practices in public examinations conducted by designated authorities.
●  The Act covers examinations conducted by agencies such as the Union Public Service Commission (UPSC), Staff Selection Commission (SSC), Railway Recruitment Boards (RRBs), National Testing Agency (NTA), Institute of Banking Personnel Selection (IBPS), and other notified public examination authorities.
●  It criminalises offences such as question paper leakage, unauthorised access to examination systems, tampering with examination processes, impersonation, and the involvement of organised crime networks in examination fraud
.●  The Act provides for stringent punishment, including imprisonment, monetary fines, and action against institutions or service providers found complicit in unfair practices.
●  The legislation seeks to uphold transparency, fairness, accountability, and the sanctity of public examinations, thereby protecting the constitutional principles of equality of opportunity and merit-based selection.
